These terms apply when a consumer orders a printed book from opuscule Studio for delivery in mainland France. The Studio is free: you only pay for the book, when you print it. You accept these terms by ticking the box shown before payment. The version that applies is the one in force on the day you order.

1. The seller

2. The book

The content is put together on your Mac from your own sessions. You review and approve it before ordering: the Studio preview shows the book as it will be printed. Digital printing can show slight color differences from your screen and a trim shifted by a few millimeters. These are not defects.

3. Ordering

  1. You compose and approve your volume in the Studio.
  2. The Studio builds the PDF on your Mac and checks it: format, fonts, image resolution.
  3. You enter the delivery address. The total price appears, delivery included, with its breakdown.
  4. You accept these terms, then the "Pay … and print" button takes you to Stripe's secure payment page.
  5. The order is binding once Stripe confirms the payment. You then get an order confirmation by email, with these terms attached.
  6. The Studio then uploads the PDF straight to the printer, who makes your book.

Until you pay, you can go back and change anything: content, interior, address.

4. Price and payment

Prices are in euros, all taxes included, delivery included. They depend on the page count, the interior and the address, and are shown with their breakdown before payment: printing, delivery, printer fees, opuscule service.

You pay in full when you order, with the methods offered on the Stripe page (cards in particular). Opuscule never sees or stores your card details.

5. Printing and delivery

Your book is printed and shipped by our printer, Lulu Press, Inc., and its print partners. It is delivered by post to the address you entered, in mainland France only, within 30 days of the order at the latest.

If it hasn't arrived by then, you can ask us in writing to deliver it within a reasonable extra period. If it still doesn't arrive, you can cancel the order and get a full refund within 14 days (articles L216-6 and L216-7 of the French consumer code).

The book travels at our risk until you receive it. If it gets lost or arrives damaged, we reprint it and send it again at no cost, or refund you if you prefer. If the parcel comes back because the address you entered was wrong, a new shipment may be charged at the delivery price.

6. No right of withdrawal

Your book is made from your own content and to your choices: it is made to your specifications and clearly personalized. The 14-day right of withdrawal therefore does not apply (article L221-28, 3°, of the French consumer code). You acknowledge this by ticking the box before payment. Your rights if the book is defective are unaffected.

7. Defects and legal guarantees

Badly printed, badly bound, damaged, or different from the preview you approved: write to us at meffysto@gmail.com with your order number and a photo. We reprint it and send it at no cost, or refund you.

Not defects: the content you approved (text, images, choice of sessions) and the slight differences described in section 2.

In every case you have the following legal guarantees (translation of the notice required by French law):

The consumer has two years from delivery of the goods to invoke the legal guarantee of conformity if a lack of conformity appears. During this period, the consumer only has to prove that the lack of conformity exists, not when it appeared.

Where the contract of sale provides for the continuous supply of digital content or a digital service for more than two years, the legal guarantee applies to that digital content or service throughout the planned supply period. During this period, the consumer only has to prove that the lack of conformity affecting the digital content or service exists, not when it appeared.

The legal guarantee of conformity requires the seller, where relevant, to provide all updates needed to keep the goods in conformity.

The legal guarantee of conformity entitles the consumer to have the goods repaired or replaced within thirty days of the request, free of charge and without major inconvenience.

If the goods are repaired under the legal guarantee of conformity, the consumer gets a six-month extension of the initial guarantee.

If the consumer asks for a repair but the seller imposes a replacement, the legal guarantee of conformity is renewed for two years from the date of replacement.

The consumer may obtain a price reduction while keeping the goods, or end the contract with a full refund against return of the goods, if:
1° the seller refuses to repair or replace the goods;
2° the repair or replacement takes place after thirty days;
3° the repair or replacement causes the consumer major inconvenience, in particular where the consumer ultimately bears the cost of taking back or removing the non-conforming goods, or the cost of installing the repaired or replacement goods;
4° the lack of conformity persists despite the seller's unsuccessful attempt to fix it.

The consumer is also entitled to a price reduction or to terminate the contract when the lack of conformity is so serious that an immediate price reduction or termination is justified. The consumer then does not have to ask for repair or replacement first.

The consumer is not entitled to terminate the sale if the lack of conformity is minor.

Any period during which the goods are unavailable for repair or replacement suspends the remaining guarantee until the goods are returned in working order.

These rights result from articles L. 217-1 to L. 217-32 of the French consumer code.

A seller who obstructs the legal guarantee of conformity in bad faith faces a civil fine of up to 300,000 euros, which may be raised to 10% of average annual turnover (article L. 241-5 of the French consumer code).

The consumer also benefits from the legal guarantee against hidden defects under articles 1641 to 1649 of the French civil code, for two years from discovery of the defect. This guarantee entitles the consumer to a price reduction if the goods are kept, or a full refund against return of the goods.

8. Your content

You alone are responsible for your book's content. You confirm that you have the right to print what it contains (text, screenshots, images) and that it breaks no law and infringes no one's rights.

Opuscule doesn't read your book. It is put together on your Mac, then the PDF goes straight to the printer through a signed link. It is deleted from our temporary storage as soon as the printer has fetched it, and after 24 hours at the latest. The printer keeps the files under its own policy to make and ship the book. If it refuses a file or content that breaks its rules, we refund you in full.

9. Personal data

For your order, we process your name, address, phone number (required by the carrier) and email. They are shared with Stripe for payment and with Lulu for printing and delivery. Details, retention periods and your rights: privacy policy.

10. Complaints and mediation

If a dispute can't be settled with us after a written complaint, you can use the consumer mediator free of charge: to fill in: mediator's name, website and address (article L612-1 of the French consumer code).

11. Governing law

These terms are governed by French law. In a dispute, you may go, as you choose, to any court with territorial jurisdiction under the French code of civil procedure, or to the court of the place where you lived when you ordered or when the harmful event occurred (article R631-3 of the French consumer code).
